WEBSITE TERMS & CONDITIONS

1. WHO WE ARE

Roxxi’s Tattoo (formerly Roxxi & Sioux Skin trading as Roxxi’s Poolroom) is based in Victoria, Australia. We provide tattoo services, consultations, artwork, and related products and digital services.

In these Terms, “we”, “us”, and “our” refers to Roxxi’s Tattoo. “You” refer to any website user, customer, or client.

2. ACCEPTANCE OF TERMS

By accessing or using our website, booking services, purchasing products, or engaging with our social media or digital platforms, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree, you must not use our services or website.

3. ELIGIBILITY (STRICTLY 18+ ONLY)

You must be at least 18 years of age to:

  • Book tattoo services
  • Attend tattoo appointments
  • Purchase services or deposits

We reserve the right to request valid government-issued identification at any time. Failure to provide proof of age will result in refusal of service without refund.

4. CHANGES TO TERMS

We may update these Terms at any time to reflect:

  • Legal or regulatory changes
  • Business or operational updates
  • Service improvements

The updated Terms take effect once published on our website. Continued use of our services indicates acceptance of updated Terms.

5. BOOKINGS & DEPOSITS

To secure a tattoo appointment:

  • A deposit may be required
  • Deposits confirm your booking and reserve artist time
  • Deposits are generally non-refundable except where required under Australian Consumer Law (ACL)
  • Deposits may be credited or transferred at our discretion if adequate notice is provided

Late arrival may reduce your appointment time or result in forfeiture of deposit.

6. CANCELLATIONS & RESCHEDULING

You must provide at least 48 hours’ notice to cancel or reschedule.

If you fail to provide sufficient notice:

  • Your deposit may be forfeited
  • A cancellation fee may apply
  • You may be required to pay a new deposit to rebook

We may also reschedule appointments due to unforeseen circumstances, artist availability, or safety concerns.

7. TATTOO CONSENT & MEDICAL DISCLOSURE

Before any tattoo procedure, you must complete a consent form.

You agree to disclose all relevant medical information, including:

  • Skin conditions or sensitivities
  • Allergies (including ink or latex allergies)
  • Blood disorders or clotting issues
  • Medications affecting bleeding or healing (e.g. blood thinners, acne medication)
  • Pregnancy or relevant medical conditions

You acknowledge:

  • Tattooing carries inherent risks (infection, allergic reaction, healing complications)
  • Failure to disclose relevant medical information may result in refusal of service
  • We are not responsible for complications arising from undisclosed conditions

8. RIGHT TO REFUSE OR STOP SERVICE

We may refuse or discontinue service at any time if:

  • Medical or safety risks are present
  • You are under the influence of drugs or alcohol
  • Behaviour is abusive, unsafe, inappropriate, sexist or racist
  • The requested tattoo is unsafe or not suitable for tattooing
  • Legal or professional standards would be breached

No refund is guaranteed where refusal is due to your conduct or failure to disclose information.

9. PRICING & PAYMENTS

  • All prices are in Australian Dollars (AUD)
  • Prices exclude GST where applicable
  • Prices are subject to change before booking confirmation
  • Payment must be made via approved payment methods

We do not store full credit card details.

Failure to pay may result in cancellation of services or bookings.

10. REFUNDS & AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL).

However:

  • Change of mind does not entitle you to a refund
  • Deposits are generally non-refundable
  • Refunds are only provided where required by law
  • If we cannot provide a service, you may be entitled to a refund or credit

11. HEALTH RISKS & AFTERCARE

Tattooing involves risks including:

  • Infection
  • Allergic reaction
  • Scarring
  • Fading or healing variation

You agree to:

  • Follow all aftercare instructions provided
  • Take responsibility for proper healing
  • Seek medical advice if complications arise

We are not liable for issues caused by failure to follow aftercare instructions.

12. INTELLECTUAL PROPERTY

All content including:

  • Tattoo designs
  • Artwork
  • Website content
  • Logos and branding

remains the property of Roxxi’s Tattoo unless otherwise agreed in writing.

You may not copy, reproduce, distribute, or commercially use our content without permission.

13. PORTFOLIO & IMAGE USE

We may photograph completed tattoos for:

  • Portfolio
  • Social media
  • Website
  • Marketing

You may verbally request, or request in writing before your appointment that your tattoo not be photographed.

14. DIGITAL COMMUNICATIONS

By using our services, you agree to receive electronic communications including:

  • Booking confirmations
  • Appointment reminders
  • Service updates

15. PRIVACY

Your use of our services is also governed by our Privacy Policy, which explains how we collect, store, and use personal information, including sensitive medical information.

16. LIABILITY LIMITATION

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential loss
  • We are not responsible for outcomes beyond our control
  • Liability is limited in accordance with Australian Consumer Law

Nothing in these Terms limits rights that cannot legally be excluded.

17. FORCE MAJEURE

We are not responsible for delays or cancellations caused by events outside our control, including:

  • Illness
  • Natural disasters
  • Government restrictions
  • Equipment failure
  • Emergencies

18. THIRD-PARTY SERVICES

We may use third-party providers including:

  • Booking platforms
  • Payment processors
  • Email and marketing tools

We are not responsible for the privacy or performance of third-party services.

19. PROHIBITED USE

You must not:

  • Use the website unlawfully
  • Interfere with website security or functionality
  • Harass staff or artists
  • Submit fraudulent bookings or chargebacks
  • Copy or misuse our content

20. TERMINATION

We may refuse service or terminate bookings or access to services at our discretion if these Terms are breached.

21. ELECTRONIC CONSENT

By booking or interacting with our systems, you agree that electronic acceptance (clicking “book”, “agree”, or similar) is legally binding.

22. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

23. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. Any disputes will be handled under Victorian jurisdiction.

24. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any service agreements, form the entire agreement between you and Roxxi’s Tattoo.
